UK Skilled Worker Visa 2026: New Rules Give Greater Protection to Exploited Workers

The UK has introduced new Skilled Worker protections for recognised victims of modern slavery. Here is what the September 2026 immigration update means for migrant workers.

A Major New Protection for UK Skilled Workers

The UK has introduced a significant new protection for migrant workers on the Skilled Worker visa, particularly those who experience exploitation or modern slavery.

Under the new immigration rules announced on 3 September 2026, certain Skilled Workers who are formally recognised as victims of modern slavery can work for another employer without being restricted to their original sponsor for the remainder of their existing permission.

The change is designed to prevent immigration status from being used to keep vulnerable workers in abusive employment.

What Has Changed?

Normally, a Skilled Worker’s immigration permission is connected to the sponsored job and employer. If the worker leaves that employment, they generally need to find another eligible sponsor and take the necessary immigration steps to remain in the UK.

The new protection creates an important exception.

Where a Skilled Worker has been referred into the National Referral Mechanism (NRM) and receives a positive Conclusive Grounds decision during their current permission, their work conditions can be amended so they can work for another employer. This can include employment, self-employment and voluntary work, subject to the rules.

Who Does This Apply To?

This is not a general right for every Skilled Worker to change employers freely.

The protection is specifically aimed at Skilled Workers who have been formally identified through the relevant UK modern slavery process as victims.

This distinction is important. A worker who simply wants to leave an employer or change jobs does not automatically qualify for the new protection.

Why Does This Matter for Migrant Workers?

The sponsorship system can create a difficult situation for workers experiencing workplace exploitation.

A worker may fear that leaving an abusive employer could affect their immigration status. The government says the new measure is intended to reduce that risk and encourage victims to come forward rather than remain trapped because of their visa conditions.

For international workers, including Nigerians working in the UK, understanding your immigration conditions is therefore just as important as securing the right job.

The Wider Skilled Worker Rules Still Matter

This new protection does not mean the UK Skilled Worker route has become easier across the board.

The route remains focused on eligible skilled occupations, approved sponsors and salary requirements. For most new Skilled Worker applications, the standard salary requirement is currently at least ÂŁ41,700 per year or the applicable going rate for the occupation, whichever is higher, although different rules and discounts can apply in specific circumstances.

Since July 2025, new Skilled Worker sponsorship has also generally been focused on jobs at RQF Level 6 or above, with exceptions for occupations appearing on relevant shortage or salary lists and transitional arrangements.

This means that having a job offer alone is not enough. Your occupation, salary, sponsor and immigration circumstances all need to fit the current requirements.

What Should Prospective Skilled Workers Do?

If you are planning to move to the UK for work, do not rely on older visa information circulating online.

Before accepting an offer or paying an agent, check:

  • Whether your occupation is eligible for sponsorship.
  • Whether the employer is authorised to sponsor Skilled Workers.
  • Whether the proposed salary meets the applicable requirement.
  • Whether the role and occupation code have been correctly identified.
  • What your visa conditions allow you to do.
  • Whether your long-term career and immigration plans align with the route you are considering.

The UK immigration system continues to change, so information that was correct a year ago may no longer apply to a new application.

What This Means for Professionals

For professionals considering UK employment, the message is simple: the opportunity is still there, but preparation matters more than ever.

A strong international job application requires more than a CV and a job search. You need to understand whether your occupation qualifies, target legitimate sponsoring employers and present your professional experience in a way that meets UK expectations.

And if you are already in the UK on a Skilled Worker visa, understanding your rights and conditions can help you make informed decisions if your employment situation changes.
